NEW DELHI: The PIL difficult the appointment of Rakesh Asthana as Delhi Police commissioner was dismissed by the excessive court docket on Tuesday.
The petition filed by lawyer Sadre Alam was dismissed by a bench of Chief Justice DN Patel and Justice Jyoti Singh.
The petitioner had prayed for quashing of the July 27 order issued by the ministry of residence affairs appointing Gujarat-cadre IPS officer Asthana because the Delhi Police commissioner, and in addition the order granting inter-cadre deputation and extension of service to him.
“The impugned orders (of MHA) are in clear and blatant breach of the instructions handed by the Supreme Court docket of India in Prakash Singh case as respondent no.2 (Asthana) didn’t have a minimal residual tenure of six months; no UPSC panel was shaped for appointment of Delhi Police Commissioner; and the standards of getting a minimal tenure of two years has been ignored,” the plea had submitted.
